2022 Pocket Nurse Holiday Giveaway

Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. MAKING A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

This Giveaway is open to legal residents of the contiguous United States of America and District of Columbia.  Prize will only be awarded and/or delivered to addresses within said locations. All federal, state and/or local taxes, fees, and surcharges are the sole responsibility of the prize winner. Failure to comply with the Official Rules will result in forfeiture of the prize.

Entry Period. The Pocket Nurse 2022 Holiday Giveaway  (\"Giveaway\") begins on Monday, November 28th, 2022 at 12:00 a.m. EST and ends on Friday, December 16th, 2022 12:00 a.m. EST. (the \"Entry Period\").

Sponsorship. The sponsor of this Giveaway is Pocket Nurse ("Sponsor"). By participating in the Giveaway, each Entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Sponsor, which shall be final and binding in all respects. Sponsor is responsible for the collection, submission or processing of Entries and the overall administration of the Giveaway. Entrants should look solely to Sponsor with any questions, comments or problems related to the Giveaway. Sponsor may be reached by email at communications@pocketnurse.com during the Promotion Period. 

Eligibility. Open to legal residents of the contiguous United States and District of Columbia who are 18 years of age or older (the \"Entrant\") at the time of entry. Sponsor, and their respective parents, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies and each of their respective officers, directors and employees (the \"Promotion Entities\"), are ineligible to enter the Giveaway or win a prize. Household Members and Immediate Family Members of such individuals are also not eligible to enter or win. "Household Members" shall mean those people who share the same residence at least three months a year. "Immediate Family Members" shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses. This Giveaway is subject to all applicable federal, state and local laws and regulations and is void where prohibited or restricted by law.  

How to Enter.

  • Instagram – All 3 Actions Must be Done
    • Must follow @pocketnurse_pgh, like the pinned post, and tag 3 friends
  • Facebook Option 1 – All 3 Actions Must be Done
    • Must like our page, like the post, and tag 1 friend
      • If you have your Facebook privacy settings set to not show publicly what pages you like, you would need to change this so we can prove that you officially liked the page.
  • Automated or robotic Entries submitted by individuals or organizations will be disqualified. Internet entry must be made by the Entrant. Any attempt by Entrant to obtain more than the stated number of Entries by using multiple/different identities, registrations, logins or any other methods, including, but not limited to, commercial contest/sweepstakes subscription notification and/or entering services, will void Entrant's Entries and that Entrant may be disqualified. Final eligibility for the award of any prize is subject to eligibility verification as set forth below. All Entries must be posted by the end of the Promotion Period in order to participate. Sponsor's database clock will be the official timekeeper for this Giveaway.   
  • Limitation of Entries. Limit one entry per person per Instagram OR Facebook account.  No third party entry or entry through any sweepstakes or giveaway service is permitted. Any person who attempts or otherwise encourages the entry of multiple or false contact information under multiple identities or uses any device or artifice to enter or encourage multiple or false entries, as determined by Sponsor, will be disqualified. Use of robotic entry devices is strictly prohibited. 
  • Prizes. On Monday, December 19th, 2022 the sponsor will pick one (1) winner to win the below 
    • One (1) $100 FIGS Gift Card
    • One (1) $100 Lululemon Gift Card 
    • One (1) $100 Target Gift Card 
  • Only one prize per person and per household will be awarded.  Prizes cannot be transferred, redeemed for cash or substituted by winner.  Sponsor reserves the right in its sole and absolute discretion to award a substitute prize of equal or greater value if a prize described in these Official Rules is unavailable or cannot be awarded, in whole or in part, for any reason. The ARV of the prize represents Sponsor's good faith determination. That determination is final and binding and cannot be appealed. If the actual value of the prize turns out to be less than the stated ARV, the difference will not be awarded in cash. Sponsor makes no representation or warranty concerning the appearance, safety or performance of any prize awarded. Restrictions, conditions, and limitations may apply. Sponsor will not replace any lost or stolen prize items. No substitution of prizes will be permitted. If the Prize cannot be awarded for any reason, Sponsor reserves the right to substitute a prize of equal or greater value. The Winner may waive their right to receive the Prize. The Prize is non-exchangeable, non-refundable, has no cash value, and must be accepted by the Winner as awarded. Winner is solely responsible for complying with any applicable federal, state and local laws and regulations applicable to the Prize. All costs associated with acceptance or use of the Prize, except as expressly set forth in the Official Rules, are the sole responsibility of the Winner. A Pocket Nurse® account is required to make a purchase through pocketnurse.com or via phone or email with Pocket Nurse Customer Service.   • Winner Selection. The Winner of the Giveway will be selected in a random drawing from among all eligible Entries received throughout the Promotion Period.  Odds of winning will vary depending on the number of eligible Entries received.
  • Winners will be selected in a random drawing from among all eligible entries
    collected during the Entry Period taking place on or about 12/19/2022 at Sponsor’s principal place of business. The drawing will be conducted by Sponsor, whose decisions and interpretations on all matters relating to the Giveaway and these Official Rules are final and binding in all respects. Sponsor reserves the right to disqualify any entrant or winner and may refuse to award a prize to a person who is not eligible or has violated a rule, gained unfair advantage in the Giveaway, or obtained winner status using fraudulent means. If there is a dispute about the identity of an entrant, prize will be awarded to the natural person to whom the Instagram or Facebook account is assigned by the internet service provider responsible for the domain associated with the submitted Instagram or Facebook account. If winner is found to be ineligible or not in compliance with Giveaway rules, winner will be disqualified and an alternate winner will be awarded the prize in a separate random drawing.
  • Winner Notification and Prize Delivery. Winner will be notified by Instagram Direct Message or Facebook comment on giveaway post.  Winners have 48 hours  to accept prize(s).  Failure to accept prizes in the adequate time will result in sponsor proceeding to an alternate winner.  Alternate winners will have 48 hours to respond.  Sponsor is not responsible for any delay or failure to receive notification for any reason, including inactive social media account, technical difficulties associated therewith, or Winner’s failure to adequately monitor social media account.

    Any winner notification not responded to or returned as undeliverable may result in prize forfeiture. The potential prize winner may be required to sign and return an affidavit of eligibility and release of liability, and a Publicity Release (collectively \"the Prize Claim Documents\"). No substitution or transfer of a prize is permitted except by Sponsor. Prize will be sent to winner by U.S. mail within fourteen (14) days after winner has been notified and accepted the prize. If prize is returned as undeliverable, then prize will be forfeited and another winner will be randomly drawn.
  • Privacy. Any personal information supplied by you will be subject to the privacy policy of the Sponsor posted at http://info.pocketnurse.com/privacy-policy01. By entering the Giveaway, you grant Sponsor permission to share your Instagram or Facebook account name and any other personally identifiable information with the other Giveaway Entities for the purpose of administration and prize fulfillment, including use in a publicly available Winners list.

    Limitation of Liability. Sponsor assumes no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty or failed electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Giveaway; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, camera, computers or providers utilized in any aspect of the operation of the Giveaway; (d) inaccessibility or unavailability of any network or wireless service, the Internet or website or any combination thereof; (e) suspended or discontinued Internet, wireless or landline phone service; or (f) any injury or damage to participant's or to any other person’s computer or mobile device which may be related to or resulting from any attempt to participate in the Giveaway or download of any materials in the Giveaway.

    If, for any reason, the Giveaway is not capable of running as planned for reasons which may include without limitation, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Giveaway, the Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Giveaway in whole or in part. In such event, Sponsor shall immediately suspend all drawings and prize awards, and Sponsor reserves the right to award any remaining prizes (up to the total ARV as set forth in these Official Rules) in a manner deemed fair and equitable by Sponsor. Sponsor and Released Parties shall not have any further liability to any participant in connection with the Giveaway.
  • Social Network Disclaimer.  A Instagram or Facebook account is required to enter. If you don’t already have an account, visit instagram.com or Facebook.com create one. It is free to create an account. Only one account may be used to enter. If an entrant is found to have used multiple accounts to enter on the same platform, that entrant will be disqualified. This promotion is in no way sponsored, endorsed or administered by, or associated with Instagram, Facebook, FIGS, Lululemon, or Target. You understand that you are providing your information to the Sponsor and not to Instagram or Facebook. By participating via Instagram or Facebook, participants are also subject to Instagram and Facebook's data policy and terms of use.
     
    Winner List/ Official Rules. To obtain a copy of the Winner List or a copy of these Official Rules, send your request along with a stamped, self-addressed envelope to Pocket Nurse cc: 2022 Holiday Giveaway at 610 Frankfort Road, Monaca, Pa. 15061. Requests for the names of the winners must be received no later than January 19th, 2022. The winner list will be sent out in an email after winners are contacted and notified.
